Evictions in the City of Seattle

No one ever wants to evict a tenant - it's a frustrating process that is both time-consuming and emotionally draining. The only thing worse for a property owner is being sued for something over which the property owner has microscopic or no control. Unfortunately, in the worst case, you may be forced to evict a tenant for any whole of reasons. Eviction is not an easy process, particularly if you are dealing with a tenant who is experienced at circumventing the eviction process. If you have any doubts or if you have not done this before, you should consult a suited real estate attorney. Before you begin an eviction, you should be distinct that your property complies with the City of Seattle's Housing and construction Maintenance Code. If you are dealing with a difficult tenant, you can be distinct that their first performance will be to article you to City for non-compliance for one or more of the provisions set forth in the City of Seattle's Housing and Maintenance Code.

Just Cause Evictions In Seattle, as a landlord, you cannot evict a tenant who is under a lease for any reason. Under the State of Washington's Residential Landlord-Tenant Act, (Rcw 59.18), "it shall be unlawful for the landlord to take off or exclude from the premises the tenant thereof except under a court order so authorizing." Moreover, a landlord must prove that "just cause" exists to evict a tenant. The reasons listed, only the reasons listed, at Smc 22.206.160(C) constitute "just cause." The most coarse just causes for eviction, however, are the following: (i) failure to pay rent, (ii) failure to comply with one or more terms of the rental agreement, or (iii) waste or nuisance by the tenant (including a drug-related performance nuisance).

The First Step - notice As with any legal proceeding, the first step involves some form of notice to the tenant. The formalities are leading and the process must be strictly followed or the court will rule against the landlord. The process for perfecting notice is set forth in information in Rcw 59.12.040, but, at a high level, there are three ways to serve Notice. The first is by personal service, which means you (the landlord) or someone who is over the age of 18 must personally and the notice to the tenant or to an adult who is living in the unit. The second is by conspicuously posting and mailing, which means that you must post the notice on the door of the tenant's unit and then send the tenant a copy by certified mail. Some attorneys advise that you that take a picture of the door with the notice posted and keep that picture with your records. The third is with regard to subtenants and the regulations wish you to do both the personal assistance and the conspicuous posting and mailing. Once you have served Notice, you must file a sworn announcement to that succeed and your sworn announcement along with the complaint must be filed with the court. You should consult with a suited real estate attorney if you have not done this before, or if you have any questions. The courts are very strict about strict adherence to these procedures, which means you could lose your case not on the merits, but because you have failed to succeed the procedures to the letter.

The Second Step - The Summons And The Complaint The next step is to serve the tenant with something called a summons and complaint, which is the formal process required to kick off a lawsuit, By the way, the formal name of the lawsuit to evict a tenant is called an Unlawful Detainer Action. The summons and complaint is typically served on the tenant by an private whom you hire called the process server. As the plaintiff in the Unlawful Detainer Action, you may not serve the summons and complaint yourself. Process servers specialize in delivering summons and complaints. Your attorney can advise you on how best to support a process server. The tenant must rejoinder your summons and complaint by the given deadline, which must be at least seven days from their receipt of the summons and complaint.

The Third Step - The Hearing The next step is an event called the Show Cause hearing. Although a date for Show Cause need not be served with the summons and complaint, it is commonly advisable to serve all the documents at the same time. If you do not supply the tenant with a date for a Show Cause hearing and the tenant formally or informally responds to your complaint, then you must kick off a Show Cause hearing to continue the eviction process, which delays the process. Better to supply the Show Cause hearing date up-front. At the Show Cause hearing, the judge will characterize evidence, along with testimony, from both sides. Here is where your records, documents and other admissible evidence, if properly recorded and documented, will prove to be invaluable. You must put emotion aside and you must supply a compelling, rational and factually based story to the judge. The Show Cause hearing is short though, typically fifteen minutes or less, so you have to be concise, you have to be organized, and you have to make your case in a compelling fashion. Do not engage in theatrics. The landlord or the property employer must attend the Show Cause hearing. There are three possible outcomes from the Show Cause hearing. The first outcome is extraction of the case because the court finds that you are not entitled to possession. This regularly occurs because you, the landlord, have made some sort of procedural error.

The second is that the case gets set for trial because the issues are so complicated that they cannot be resolved at a fifteen microscopic hearing. You want to try to avoid this second scenario, particularly if you a first-time property owner. The costs of a full trial can be marvelous for a small property owner and the time, not to mention the emotional toll, can be significant. As unpalatable as this sounds, it may make firm sense to pay the tenant to move out. For instance, you can offer to pay the tenant's keen expenses if they move out within seven days (or some inexpensive period of time). The third outcome (and the adored outcome) is that the court rules in your favor and an eviction order is issued along with the judgment.

The Fourth Step - The Sheriff Once you have the writ of restitution, which is the document issued by the court, the sheriff will serve the writ on the tenant. The tenant will then have three firm days to vacate. If the tenant does not vacate, you must touch the sheriff's division and arrange for a physical eviction. For your information, the sheriff will not move any of the tenant's personal belongings. Their job is to enforce the writ by way of eviction, not to move furniture or other personal belongings. You must arrange some other means to have the tenant's belongings removed.

The most commonly asked query about Evictions - if my tenants do not pay rent on a timely basis, can I change the locks when they are not home and confiscate their personal belongings? This type of remedy commonly known as a "self-help" remedy was quite coarse a century ago when the property owner was king and had largely unfettered discretion with regard to the habit of their property and tenants. That was, however, a century ago. Self-help remedies are, per se, illegal and the laws prohibit lease agreements that consist of provisions waiving a tenant's ownership in this regard. Not only is changing locks, but terminating utilities or taking ownership of a tenant's personal property for non-payment of rent are also illegal.

Rodney White - America's Hottest Artist - Move Over Andy Warhol

If you have ever watched The Abc sitcom "Freddie" and Abc's "Extreme Makeover Home Edition", you may have already viewed some of Rodney White's overwhelming art pieces. Once in a while something so unique, eye-catching and visually pleasing comes along that it just as a matter of fact grabs you. This is the case with the winning aggregate of color, rustic style, and timely messages that Rodney White has created.

One critic writes of Rodney White's work, "The most overwhelming aspect of this work is that it isn't created on a computer but on a canvas instead. I'm amazed by these overwhelming typographical beauties. The retro feeling, grunch supervene and nice color combinations make them as a matter of fact stand out. Most of his work contains meaningful messages. Rodney also uses dissimilar materials and techniques, mainly acrylic. Most of his paintings are on wood but some are on metallic and there is even one on a faux brick panel."

Ashley Furniture

This Georgian artist, now a New Yorker residing in Brooklyn, has an ever-growing audience buying and collecting his works. His popularity soared after his national exposure on television, and the past two years have been a turning point for this self-taught artist who hails from Augusta, Georgia.

Rodney White was born in Augusta in 1976. He lived in Atlanta from 1997-2005, and then made the move to Brooklyn, New York where he works and lives. While his time in Atlanta, Rodney did attend a technical construct to study visual communications in 1999. In 2003, he had his first solo exhibition. His "Solo Exhibitions" contain the following: 2005 "Future Becomings" Claret Arts: Atlanta, Georgia; 2004 "Retro Notions" Claret Arts: Atlanta, Georgia; 2004 "Recent works" Octane: Atlanta, Georgia; and 2003 " Love is..." Open Artist Studio: Atlanta, Georgia.

Since 2004 Rodney White has also accumulated quite a list of credits for "Group Exhibitions" where his work has been admired. These contain the following:

What does Rodney think about his exposure on network Tv? "There seems to be some gravitational pull in the middle of my work and the Abc network. My work was chosen to appear on greatest Makeover Home Edition with the Crawford Smith Family. A whopping 9 pieces were hanging in the home, And you could as a matter of fact see them on television. It was a total surprise to me. My mom called while I was in the middle of painting to tell me and roughly immediately after the images were shown my phones start ringing off the hook with calls from friends and family saying that they saw it and population congratulating me. It was a big deal the first time and big deal again. What was seen on the show were canvas transfers of my paintings."

If you ask Rodney what inspires him, he would say, "Everything. I see things in any place and daily that gives me some idea for my pieces. I love to visit flea markets and aged markets. I observation the natural aging of things around us. Billboard signs, buildings, packages, and aging paper catch my attention. I seek to replicate the rusting and decaying look of things I see."

Where did his desire to be an artist all begin? He claims that he has dabbled in art since his pre-kindergarten days. He tells the story of rushing straight through his class work so that he could be the first one back to the scrap paper box in the classroom. In fact, he admits that he would fill the blank pages in the front and back of encyclopedias because he thought, "Those sheets were put there for me."

When Rodney added explains his view on his own work, he shares his fascination with poetry, typography, advertising construct and vintage signs. He says that by trying to encourage others to observation those things that he is, "learning, teaching, and inspiring." In describing his work and its association to the past, he says, "The past has all the time been something that I've felt we could/should learn from, and advertising has all the time been a reflection of the desires and societal norms that are driven into the hearts and minds of consumers. Well...what if those driven desires became more as a matter of fact influential on our minds and inner beings? Thus, giving us something to take into the way we live our lives, and approach the world around us."

Rodney has a love for the deterioration of things which includes objects and surfaces. He notices how things have developed and aged. He takes note of aged labels, old books and vintage posters which have that "experienced look." Because he believes that art will be around a long time, he feels the best way to leave messages behind is straight through art.

Rodney also says that he gets inspiration from music, other artists, poets, and literature. He enjoys music of all kinds and says, "I'm working on a puny taste for country. And that doesn't seem to be working out. It is much harder than I thought." Other artists that he admires are: Sabrina Ward Harrison, Rik Catlow, Anja Kroenke, Tim Marrs, and Ashley Wood. Among the poets he reads are Saul Williams and Sabrina Ward Harrison.

When speaking of his friends, Rodney says, "A lot of my paintings come from what I write often in my Journal/Idea books. A lot of times my friends and the population I meet say the most fantastic things and they sometimes never mean them the way I hear them. Lucky me I guess."

When asked about his interests, Rodney says, "I love furniture and dreaming up living spaces. Décor stuff. Movies, collecting and listening 2 music. Books (Angels, Aliens, Theology) and Writing. Learning to enjoy the small things about life - like walking in the sand barefoot. Riding my bike around the city. Daily getaways listening to my iPod. (I tend to as a matter of fact visit new places when I do this). Talking and making...connections with people. Learning about population and their stories. Everyone has them - not Everyone has person that wants to listen to them & Dreaming...Always Dreaming."

A Guide to Designing a High School Musical Themed Bedroom

Disney's High School Musical fever is sweeping the nation! If your child has caught the Zach Effron or Ashley Tisdale bug, then read on. Here's the perfect High School Musical bedroom theme decor that will put her right in the middle of the show! We'll look at accents, bedding and linens, floor covering, wall, art, furniture, lighting and much more.

Wall Decor: All room decor must necessarily begin with walls. Sure you could just hang up a bunch of posters, but that's pretty boring and they tear positively also. I would withhold on poster for the door front. This lets visitors know that a With the Disney High School Musical theme, we want to originate a theater illusion.

1. Paint the walls in a good potential semi-gloss latex paint. Many manufacturers make a children's room paint that washes well. Pick a neutral tan or beige color.

2. Use a fluorescent branched floor lamp with pink bell shaped shades. The lights shine upward and each subject can be bent in distinct directions. This kind of lamp is ready from most major sell outlets.

3. Hang a string of white holiday lights along the walls.

4. Dangle real or replica theater spotlights in each corner. Most lighting outlets and hardware market sell versions of spotlights that are simple to hang.

Furniture:

1. Bed: several options are available. The first High School Musical was located in Albuquerque, New Mexico and so the bed may have Mexican theme. High School Musical 2 has a more tropical theme. Using a traditional bed, a tropical theme can be created by hanging a grass table skirt like those used at luaus colse to the base of the bed for a bed skirt. Tie inflatable palm trees to the posts of the bed.

2. Stage: Your High School Musical lover will need her own stage to custom and laid out on. Make a small ledge along one wall of the bedroom. Build it about three feet wide and one foot off the floor. Make it as long as you wish. Be sure to withhold it well. You can also Purchase a low table on sturdy metal legs to use as a small stage. These can be found inexpensively in most mass merchandise stores. Anything you build must be strong sufficient for the child to dance on. Hang a curtain in front like a theater curtain. You can use a shower curtain in a Hawaiian print. Attach two hooks at the same height on opposite walls. String a length of clothes line colse to the hooks and hang the curtain from this.

3. Dance barre: Dancers need a custom barre. You can put up a ballet barre positively using a stairway hand railing. Attach this horizontally along a wall. You can attach it to the wall with the stage.

4. Over from the stage, set up a large floor mirror for her to watch herself as she rehearses.

5. Karaoke machine: Since Troy and Gabriella originally met at Karaoke, a small transported motor is a must for your High School Musical decor. Be sure that there is a transported microphone for her to use. This should be on the stage.

6. Costumes and Screen: acquire costumes from theater distributors and second hand store. Hang them on a rack with a screen to change behind.

7. Dresser: Set up a vanity table with a lighted mirror to simulate a theater dressing table. Pick one with drawers to store clothing. Purchase some theater make-up to custom with.

Curtains And Bed Linens: You can find licensed Disney High School Musical accessories in many sell stores. You can also make your own. Fabric and Craft market sell fabric printed with Disney characters and themes. Purchase cotton fabric for curtains and sheets and polar fleece for blankets and pillows.

Your child can sing and dance her way to stardom with her own Disney High School Musical themed bedroom!
